BeBetta Terms of Use
BeBetta is a brand of Isocial Sports Private Limited (“BeBetta”). Through BeBetta, along with its BeBetta App, operates as a sports prediction and betting platform under the brand name ‘BeBetta’ through Betcoins (as defined below), aiming to connect and engage sports enthusiasts, fans, and casual followers, through predictions and custom challenges, WITHOUT INVOLVING REAL-MONEY TRANSACTIONS. BeBetta, as used herein shall be construed as a collective reference to BeBetta and the BesBetta App.
Usage of BeBetta
Any person (“User”) accessing BeBetta or the BeBetta App (“BeBetta platform”) for participating in the Games (as defined below) and Bets (as defined below), engaging inSocial Events (as defined below) and accessing the Store (as defined below) available on BeBetta platform (“BeBetta Services”) shall be bound by these Terms of Use, and all other rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services.
BeBetta shall be entitled to modify these Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services, at any time, by posting the same on BeBetta. Use of BeBetta constitutes the User’s acceptance of such Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services, as may be amended from time to time. BeBetta may, at its sole discretion, also notify the User of any change or modification in these Terms of Use, rules and regulations and Terms of Use referred to herein or provided by BeBetta, by way of sending an email to the User’s registered email address or posting notifications in the User accounts. The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta. If such options are not exercised by the User within the time frame prescribed in the email or notification, the User will be deemed to have accepted the modified Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta.
Certain BeBetta Services being provided on BeBetta may be subject to additional rules and regulations set down in that respect.
BeBetta may, at its sole and absolute discretion:
i. Restrict, suspend, or terminate any User’s access to all or any part of BeBetta or BeBetta Platform Services;
ii. Change, suspend, or discontinue all or any part of the BeBetta Platform Services;
iii. Reject, move, or remove any material that may be submitted by a User;
iv. Move or remove any content that is available on BeBetta Platform;
v. Establish general practices and limits concerning use of BeBetta Platform;
vi. Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Users to their registered email ids)
In the event any User breaches, or BeBetta reasonably believes that such User has breached these Terms of Use, or has illegally or improperly used BeBetta or the BeBetta Services, BeBetta may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User’s access to all or any part of BeBettaServices or the BeBetta Platform, deactivate or delete the User’s account and all related information on the account, delete any content posted by the User on BeBetta and further, take technical and legal steps as it deems necessary.
Users consent to receiving communications such as announcements, administrative messages and advertisements from BeBetta or any of its partners, licensors or associates.
Intellectual Property
BeBetta includes a combination of content created by BeBetta, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights (“Intellectual Property Rights”) in all software underlying BeBetta and the BeBetta Platform and material published on BeBetta, including (but not limited to) Games, Bets, Store Social Events, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and flash animation, is owned by BeBetta, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on BeBetta either in whole or in part without express written license from BeBetta
Users may request permission to use any BeBetta content by writing in to suppor@bebetta.in.
Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available on BeBetta (“Users’ Content”). Each User represents and warrants that he/she owns all Intellectual Property Rights in the User’s Content and that no part of the User’s Content infringes any third party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on BeBetta. Users agree to indemnify and hold harmless BeBetta, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on BeBetta, by such User or through the User's commissions or omissions
Users hereby grants to BeBetta and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users’ Content for any of the following purposes:
i. displaying Users’ Content on BeBetta
ii. distributing Users’ Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it, and/or
iii. storing Users’ Content in a remote database accessible by end users, for a charge.
This license shall apply to the distribution and the storage of Users’ Content in any form, medium, or technology.
All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on BeBetta(s) belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to BeBetta.
Third Party Sites, Services and Products
BeBetta may contain links to other internet sites owned and operated by third parties. Users’ use of each of those sites is subject to the conditions, if any, posted by the sites. BeBetta does not exercise control over any Internet sites apart from BeBettaand cannot be held responsible for any content residing in any third-party Internet site. BeBetta’s inclusion of third-party content or links to third-party Internet sites is not an endorsement by BeBetta of such third-party Internet site.
Users’ correspondence, transactions/offers or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. Users’ correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. User agrees that BeBetta will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third party product or service should be directed to the appropriate vendor.
BeBetta contains content that is created by BeBetta as well as content provided by third parties. BeBetta does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the BeBetta Services provided on BeBetta including while participating in any of the Bets hosted on BeBetta.
Privacy Policy
All information collected from Users, such as registration and credit card information, is subject to BeBetta's Privacy Policy which is available at https://bebetta.amnex.com/downloads/PrivacyPolicy.html
User Conduct
Users agree to abide by these Terms of Use and all other rules, regulations and terms of use of the Website. In the event User does not abide by these Terms of Use and all other rules, regulations and terms of use, BeBetta may, at its sole and absolute discretion, take necessary remedial action, including but not limited to:
i. restricting, suspending, or terminating any User’s access to all or any part of BeBetta Services;
ii. deactivating or deleting a User’s account and all related information and files on the account.
Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by BeBetta). Users further agree to update and keep updated their registration information
Users agree and acknowledge that the address related details provided, if any, by the user shall be treated as “Address on record” of the user for the purposes of Goods and Service Tax Act. In the event of the change in such details, the user shall promptly update his/her profile on the BeBetta platform or write to BeBetta atsupport@bebetta.in.
A User shall not register or operate more than one User account with BeBetta.
Users agree to ensure that they can receive all communication from BeBetta by marking e-mails or sending SMSs from BeBetta as part of their “safe senders” list. BeBetta shall not be held liable if any e-mail/SMS remains unread by a User as a result of such e-mail getting delivered to the User’s junk or spam folder.
Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify BeBetta of any unauthorized use of accounts or any other breach of security.
Users agree to exit/log-out of their accounts at the end of each session. BeBetta shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.
Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorised third party software designed to modify or interfere with BeBetta Services and/or BeBetta experience or assist in such activity.
Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying BeBetta or BeBetta’s Services.
Users agree that without BeBetta’s express written consent, they shall not modify or cause to be modified any files or software that are part of BeBetta’s Services.
Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support BeBetta or the BeBetta’s Services (each a “Server”); or (b) the enjoyment of BeBetta Services by any other User or person.
Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt BeBetta Services or any other person’s use or enjoyment of BeBetta Services.
Users shall not attempt to gain unauthorised access to the User accounts, Servers or networks connected to BeBetta Services by any means other than the User interface provided by BeBetta, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of BeBetta Services.
User shall not to publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
Without limiting the foregoing, Users agree not to use BeBetta for any of the following:
i. To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication;
ii. To harass, stalk, threaten, or otherwise violate any legal rights of other individuals;
iii. To publish, post, upload, e-mail, distribute, or disseminate (collectively, “Transmit”) any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content;
iv. To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, BeBetta, any software, hardware, or telecommunications equipment;
v. To advertise, offer or sell any goods or services for any commercial purpose on BeBetta without the express written consent of BeBetta;
vi. To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner;
vii. To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material;
viii. To restrict or inhibit any other user from using and enjoying any public area within our sites;
ix. To collect or store personal information about other Users;
x. To interfere with or disrupt BeBetta, servers, or networks;
xi. To impersonate any person or entity, including, but not limited to, a representative of BeBetta, or falsely state or otherwise misrepresent User's affiliation with a person or entity;
xii. To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through BeBetta or to manipulate User’s presence on BeBetta(s);
xiii. To take any action that imposes an unreasonably or disproportionately large load on our infrastructure;
xiv. To engage in any illegal activities. You agree to use our bulletin board services, chat areas, news groups, forums, communities and/or message or communication facilities (collectively, the “Forums”) only to send and receive messages and material that are proper and related to that particular Forum.
xv. To engage in any action that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation.
If a User chooses a username that, in BeBetta’s considered opinion is obscene, indecent, abusive or that might subject BeBetta to public disparagement or scorn, as the case may be, BeBetta reserves the right, without prior notice to the User, to restrict usage of such names, which in BeBetta’s opinion fall within any of the said categories and/or change such username and intimate the User or delete such username and posts from BeBetta, deny such User access to BeBetta, or any combination of these options.
Unauthorized access to BeBetta is a breach of these Terms of Use, and a violation of the law. Users agree not to access BeBetta by any means other than through the interface that is provided by BeBetta for use in accessing BeBetta. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.
Use of BeBetta is subject to existing laws and legal processes. Nothing contained in these Terms of Use shall limit BeBetta’s right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of BeBetta.
Users may reach out to BeBetta through -
support@bebetta.inif the user has any concerns with regard to a match and/or Bets within Forty Eight (48) hours of winner declaration for the concerned Bet.
Persons below the age of eighteen (18) years are not allowed to participate on any of the Bets, games (by whatever name called) on the BeBetta Platform. The Users will have to disclose their real age at the time of getting access into the BeBetta Platform.
BeBetta may not be held responsible for any content contributed by Users on the BeBetta.
User hereby confirms that he / she is participating in a Bet in personal capacity and not in the course of business and /or profession.
Bets, Games, Store and Social
(a) Bets
Users are provided with the option to engage in various types of bets within the BeBetta mobile application (“Bets”). The types of Bets available may be modified by BeBetta at its discretion and without prior notice. Users have the flexibility to select their preferred Sport from those available on the Platform and then choose to participate in the available Bets. Additionally, in certain scenarios, users may be granted the privilege to create their own Bets.
(For the purpose of this Terms of Use, “Sports” encompasses a range of athletic competitions and games available for Users to engage with. Users can select their desired sport from those offered on the platform, which may include popular sports such as cricket, football, kabaddi, basketball, hockey, and others)
Participation in Bets is facilitated through the use of “Betcoins”, which serve as virtual currency within the platform. These Betcoins are utilized exclusively for engaging in bets and hold no intrinsic monetary value outside of the BeBetta application.
Users have the right to participate in the various types of Bets offered within the BeBetta App. This includes the freedom to select their desired Sport, choose from available Bet options, and engage in predictive activities using Betcoins.
In certain scenarios, Users may be privileged with the opportunity to create their own Bets, thereby exercising their creativity and ingenuity in devising unique betting scenarios. This empowers users to actively contribute to the dynamic nature of the platform and fosters a sense of ownership and engagement within the BeBetta community.
Users are obligated to comply with the Terms of Use and all applicable rules and regulations governing the participation in Bets within the BeBetta App. This includes adherence to the specified Bet types, Sports events, and guidelines outlined by BeBetta.
Users are prohibited from engaging in any form of cheating, fraud, or misconduct that undermines the integrity of the Platform. This includes but is not limited to collusion, manipulation of outcomes, use of automated bots, or any other unauthorized means to gain an unfair advantage in betting activities.
BeBetta reserves the right to modify the types of Bets offered within the Platform, including the addition or removal of Bet options, Sports events, or any other features.
BeBetta retains the authority to enforce the Terms of Use and take appropriate action against Users found to be in violation of the stipulated guidelines in accordance with User Conduct policy stipulated herein above.
By participating in bets within the BeBetta application, users acknowledge and agree to abide by the Terms of Use and all applicable rules and regulations. BeBetta reserves the right to take appropriate action against any user found to be in violation of these terms, including but not limited to account suspension or termination.
PLEASE BE INFORMED THAT ALL ACTIVITIES WITHIN THE BEBETTA MOBILE APPLICATION, INCLUDING BUT NOT LIMITED TO BETS, ARE STRICTLY FOR ENTERTAINMENT PURPOSES AND DO NOT INVOLVE THE STAKING OF REAL MONEY OR VALUABLE SECURITIES. USERS ENGAGE IN BETS USING VIRTUAL BETCOINS PROVIDED WITHIN THE APPLICATION, WHICH HOLD NO INTRINSIC MONETARY VALUE AND ARE SOLELY FOR RECREATIONAL USE. IT IS IMPORTANT TO NOTE THAT THE ASSAM GAME AND BETTING ACT, 1970 DEFINES A ‘BET’ AS ANY MONEY OR VALUABLE SECURITY STAKED ON THE OUTCOME OF AN UNASCERTAINED EVENT OR CONTINGENCY IN RELATION TO A GAME OR SPORT. HOWEVER, BETS WITHIN THE BEBETTA APP DO NOT FALL UNDER THIS DEFINITION AS THEY ARE CONDUCTED EXCLUSIVELY WITH BETCOINS AND DO NOT INVOLVE REAL MONETARY TRANSACTIONS OR HOLD AS ANY VALUABLE SECURITY.
BY PARTICIPATING IN BETS WITHIN THE BEBETTA MOBILE APP, USERS ACKNOWLEDGE AND AGREE THAT THEY ARE ENGAGING IN ACTIVITIES THAT SIMULATE BETTING SCENARIOS FOR ENTERTAINMENT PURPOSES ONLY. USERS ARE NOT STAKING REAL MONEY OR VALUABLE SECURITIES ON THE OUTCOME OF ANY EVENT OR CONTINGENCY.BEBETTA OPERATES IN COMPLIANCE WITH ALL APPLICABLE LAWS AND REGULATIONS, ENSURING THAT ALL ACTIVITIES WITHIN THE APPLICATION ADHERE TO LEGAL STANDARDS. THE PLATFORM STRICTLY PROHIBITS THE USE OF REAL MONEY FOR BETTING PURPOSES AND DOES NOT FACILITATE ANY FORM OF REAL MONEY GAMBLING.
(b) Games
Within the BeBetta App, “Games” refer to the interactive activities and challenges provided for User entertainment and engagement. These games may range from casual puzzles to competitive challenges and are designed to offer diverse gaming experiences to the Users.Users have the right to participate in the Games, earnRewards, and open Mystery Boxes offered within the BeBetta App. This includes the freedom to engage with various gaming activities and earn rewards based on their performance and achievements.
“Rewards”denote the incentives and benefits that Users can earn through Games, and other interactive activities within the BeBetta Platform. These rewards may include Betcoins, bonuses, or other incentives aimed at enhancing the User experience.
Users have the liberty to select and play Games of their choice from the diverse selection available within BeBetta App. They also have the option to avail themselves of Mystery Boxes to discover exciting rewards.
BeBetta retains full control over the Games, Rewards, and Mystery Boxes offered within the platform. This includes the right to modify, update, or remove Games, Rewards, or offers at its discretion to enhance User engagement and ensure a dynamic gaming environment.
BeBetta reserves the right to allocate Rewards to Users based on their performance, achievements, and participation within the Platform. The allocation of Rewards is determined by BeBetta and may vary based on various factors.
BeBetta may introduce offers, free bonuses, or special events from time to time to incentivize user engagement and participation. These offers are subject to change or discontinuation at the discretion of BeBetta, without prior notice to users.
Users are prohibited from engaging in any form of cheating, fraud, or misconduct that undermines the integrity of the Gaming activities. This includes but is not limited to exploiting loopholes, using unauthorized tools or software, or engaging in behaviour that provides an unfair advantage over other users.
Users are not permitted to abuse or exploit Rewards, bonuses, or Mystery Boxes for personal gain or advantage. This includes but is not limited to creating multiple accounts, manipulating Reward systems, or engaging in fraudulent activities to obtain rewards unfairly.
BeBetta reserves the right to modify, update, or amend the Terms of Use relating to games, rewards, and Mystery Boxes at any time without prior notice. Users are encouraged to review the Terms of Use periodically to stay informed about any changes or updates.
(c) Social Space
Users of the BeBetta App have the opportunity to engage in a vibrant social space, where they can connect with like-minded individuals, join communities, and interact with other Users who share similar interests and preferences.Users are welcome to join communities within the BeBetta Platform based on their favourite teams, sports, or any other criteria deemed appropriate by BeBetta. By joining a community, Users agree to abide by the community guidelines established by BeBetta from time to time and uphold the principles of respect, civility, and inclusivity.
Users are expected to engage in respectful and courteous conduct when interacting with other Users of the community. Any form of harassment, discrimination, hate speech, or abusive behaviour towards other Users will not be tolerated and may result in immediate suspension or termination of the User’s account.
Users are responsible for maintaining the privacy and confidentiality of their personal information and any sensitive data shared within the community. BeBetta shall not be held liable for any unauthorized disclosure of user information resulting from user actions or negligence.
Users are strictly prohibited from sharing or posting any content that is illegal, infringes upon the rights of others, or violates the community guidelines set forth by BeBetta. This includes but is not limited to copyrighted material, obscene or explicit content, malicious software, or any form of deceptive or fraudulent content.
BeBetta reserves the right to monitor community activities and interactions within the platform to ensure compliance with the Terms of Use and community guidelines. BeBetta may take appropriate action, including but not limited to warning, suspension, or termination of user accounts, in response to violations of the Terms of Use or community guidelines.
Users are encouraged to report any violations of the Terms of Use or community guidelines to BeBetta for prompt investigation and resolution. Reports can be submitted through the designated channels provided within the BeBetta application.
BeBetta reserves the right to modify, update, or amend the Terms of Use relating to the social space features of the platform at any time without prior notice. Users are encouraged to review the Terms of Use periodically to stay informed about any changes or updates.
(d) Store
The Store within the BeBetta App offers Users the opportunity to participate in a bidding system for various products listed on the platform. Users can view active or upcoming bids and choose to place bids on products of interest.In addition to products, Users may also have the option to purchase or bid on coupons facilitated by BeBetta within the Store. These coupons may provide discounts, special offers, or other benefits redeemable within the BeBetta App or with third-party partners.
Users understand that placing a bid constitutes a commitment to purchase the item or coupon at the bid price if their bid is successful.
BeBetta strives to provide accurate and detailed descriptions of products listed within the Store. However, Users acknowledge that product information, including but not limited to images, descriptions, and specifications, may be provided by third-party vendors or suppliers. BeBetta does not guarantee the accuracy or completeness of such information and shall not be held liable for any discrepancies or inaccuracies.
Users understand that the bidding process operates on a competitive basis, where the highest bidder at the end of the bidding period wins the item or coupon. Users are responsible for monitoring their bids and ensuring they meet the specified bid requirements, including bid increments and minimum bid amounts.
The availability of products within the Store is subject to change and may be limited based on stock availability or other factors. BeBetta does not guarantee the availability of any specific product and reserves the right to remove or modify product listings at any time without prior notice.
Users acknowledge that certain products listed within the Store may be sourced from third-party vendors or suppliers. BeBetta acts solely as a facilitator for the bidding process and does not assume responsibility for the quality, authenticity, or performance of third-party products. Users agree to direct any inquiries or concerns regarding third-party products to the respective vendors or suppliers.
Coupons purchased or won through the bidding system may be subject to specific terms and conditions outlined by BeBetta or the issuing party. Users are responsible for reviewing and complying with any redemption requirements associated with coupons, including validity periods, usage restrictions, and eligibility criteria.
(e) Lotto
Section 1: General Terms
1) Acceptance of Terms: By accessing or using the BeBetta platform, you agree to be bound by these Terms and Conditions.
2) Promoter: Isocial Sports Private Limited (ISSPL) is the operator and promoter of all competitions on the BeBetta platform.
3) Eligibility: Competitions are open to Indian residents aged 18 or over. Employees of ISSPL and their immediate family members are ineligible to participate.
Section 2: Participation
1) Registration: To participate, you must create a registered account on the BeBetta platform.
2) Purchase of Passes: You can enter competitions by purchasing Passes. Each Pass represents one entry.
3) Payment: Payments will be processed through authorized payment gateways. ISSPL is not responsible for any issues related to payment processing.
Section 3: Competitions
1) Lotto Draws: The BeBetta platform will conduct Lotto draws at specified times.
2) Winning Criteria: Winners will be determined through a random draw.
3) Prize Distribution: Prizes will be awarded to the winners as per the terms and conditions of each competition.
4) Prize Claim: Winners may be required to provide identification and address verification to claim their prizes.
Section 4: Rules of Conduct
1) Fair Play: Participants must adhere to fair play principles and avoid any fraudulent or manipulative activities.
2) Prohibited Conduct: Engaging in activities such as hacking, cheating, or interfering with the platform's operations is strictly prohibited.
3) Account Termination: ISSPL reserves the right to terminate accounts of participants who violate these Terms and Conditions.
Section 5: Limitation of Liability
1) No Warranty: ISSPL does not guarantee the accuracy, completeness, or reliability of any information provided on the platform.
2) Risk of Loss: You assume the risk of any loss or damage arising from your participation in competitions.
3) Indemnification: You agree to indemnify and hold ISSPL harmless from any claims or damages arising from your use of the platform.
Section 6: Governing Law
1) Indian Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
2) Dispute Resolution: Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in India
Legality of Game of Skill
Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867.The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.
The Bet(s) described above (across the BeBetta Services) are games of skill as success of Participants depends primarily on their superior knowledge of the games/ sports/ statistics, knowledge of players’ relative form, players’ performance in a particular territory, conditions and/or format (such as ODIs, test cricket and Twenty20 in cricket game), attention and dedication towards the Bet(s) and adroitness in playing the Bet(s). The Bet(s) also requires Participants to field well-balanced sides with limited resources and make substitutions at appropriate times to gain the maximum points.
By participating in this Bet(s), each Participant acknowledges and agrees that he/she is participating in a game of skill.
Eligibility
The Bet(s) are open only to persons above the age of 18 years.
The Bet(s) are open only to persons, currently residing in India.
Only those Participants who have successfully registered on BeBetta as well as registered prior to each match in accordance with the procedure outlined above shall be eligible to participate in the Bet and win Betcoins.
Miscellaneous
The decision of BeBetta with respect to the awarding of Rewards shall be final, binding and non-contestable.
If it is found that a Participant playing the Bet(s) is under the age of eighteen (18), BeBetta shall be entitled, at its sole and absolute discretion, to disqualify such Participant and forfeit his/her prize. Further, BeBetta may, at its sole and absolute discretion, suspend or terminate such Participant's account.
To the extent permitted by law, BeBetta makes no representations or warranties as to the quality, suitability or merchantability of any Rewards or products and shall not be liable in respect of the same.
BeBetta may, at its sole and absolute discretion, vary or modify the Rewards being offered to winners. Users shall not raise any claim against BeBetta or question its right to modify such rewards being offered, prior to closure of the Bets.
BeBetta will not bear any responsibility for the transportation or packaging of Rewards to the respective winners. BeBetta shall not be held liable for any loss or damage caused to any Rewards at the time of such transportation.
The Winners shall bear the shipping, courier or any other delivery cost in respect of the Rewards.
The Winners shall bear all transaction charges levied for delivery of cash prizes.
All Rewards are non-transferable and non-refundable. Rewards cannot be exchanged / redeemed for cash or kind. No cash claims can be made in lieu of prizes in kind.
General Conditions
If it comes to the notice of BeBetta that any governmental, statutory or regulatory compliances or approvals are required for conducting any Bet(s) or Games or if it comes to the notice of BeBetta that conduct of any such Bet(s) or Games is prohibited, then BeBetta shall withdraw and / or cancel such Bet(s) without prior notice to any Users of any Bet(s). Users agree not to make any claim in respect of such cancellation or withdrawal of the Bet or contest it in any manner.
Dispute and Dispute Resolution
The courts of competent jurisdiction at Ahmedabad, Gujarat shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the BeBetta Services provided by BeBetta (including the Bet(s)), the construction, validity, interpretation and enforceability of these Terms of Use, or the rights and obligations of the User(s) (including Participants) or BeBetta, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.
In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification (“Notification”) to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.
The place of arbitration shall be Ahmedabad, Gujarat, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.
Nothing contained in these Terms of Use shall prevent BeBetta from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard BeBetta’s interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of BeBetta to pursue any remedy for monetary damages through the arbitration described herein.
Release and Limitations of Liability
Users shall access the BeBetta Services provided on BeBetta voluntarily and at their own risk. BeBetta shall, under no circumstances be held responsible or liable on account of any loss or damage sustained (including but not limited to any accident, injury, death, loss of property) by Users or any other person or entity during the course of access to the BeBetta Services (including participation in the Bet(s)) or as a result of acceptance of any prize.
By entering the Bets and accessing the BeBetta Services provided therein, Users hereby release from and agree to indemnify BeBetta, and/ or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access to the BeBetta Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
BeBetta accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the prizes.
Users shall be solely responsible for any consequences which may arise due to their access of BeBetta Services by conducting an illegal act or due to non-conformity with these Terms of Use and other rules and regulations in relation to BeBetta Services, including provision of incorrect address or other personal details. Users also undertake to indemnify BeBetta and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by BeBetta on account of such act on the part of the Users.
Users shall indemnify, defend, and hold BeBetta harmless from any third party/entity/organization claims arising from or related to such User's engagement with the BeBetta or participation in any Bets. In no event shall BeBetta be liable to any User for acts or omissions arising out of or related to User’s engagement with the BeBetta or his/her participation in any Bet(s) or bidding of products on the Store.
In consideration of BeBetta allowing Users to access the BeBetta Services, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against BeBetta, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of BeBetta Services or related to the Bets or the Rewards, or the purchase of products from the Store.
Grievance Redressal Mechanism
In case you have any complaints or grievance pertaining to (i) any User Content that you believe violates these Terms (other than an infringement of Intellectual Property Rights) for the reporting mechanism for such claims), (ii) your access to the Platform or (iii) any User Content which you believe is, prima facie, in the nature of any material which is obscene, defamatory towards the complainant or any person on whose behalf you are making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by writing to:support@bebetta.in
In your complaint or grievance, please include the following information:
i. Your name and contact details: name, address, contact number and email address;
ii. Your relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person;
iii. The name and age of the person aggrieved or affected by the subject matter of the complaint, in case your are acting on behalf of such person and a statement, under penalty of perjury, that you are authorised to act on behalf of such person and to provide such person's personal information to us in relation to the complaint/grievance;
iv. Description of the complaint or grievance with clear identification of the User Content in relation to which such complaint or grievance is made;
v. A statement that you believe, in good faith, that the User Content violates these Terms
vi. A statement that the information provided in the complaint or grievance is accurate.
The Company respects the Intellectual Property Rights of others. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Platform belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners. You are requested to send us a written notice/ intimation if you notice any act of infringement on the Platform, which must include the following information:
i. A clear identification of the copyrighted work allegedly infringed;
ii. A clear identification of the allegedly infringing material on the Platform;
iii. Your contact details: name, address, e-mail address and phone number;
iv. A statement that you believe, in good faith, that the use of the copyrighted material allegedly infringed on the Platform is not authorized by your agent or the law;
v. A statement that the information provided in the notice is accurate, and under penalty of perjury, that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed;
vi. Your signature or a signature of your authorized agent.

On receiving such complaint, grievance or notice, the Company reserves the right to investigate and/or take such action as the Company may deem appropriate. Through BeBetta, along with its BeBetta App, operates as a sports prediction and betting platform under the brand name ‘BeBetta’ through Betcoins (as defined below), aiming to connect and engage sports enthusiasts, fans, and casual followers, through predictions and custom challenges, WITHOUT INVOLVING REAL-MONEY TRANSACTIONS. BeBetta, as used herein shall be construed as a collective reference to BeBetta and the BesBetta App.
Usage of BeBetta
Any person (“User”) accessing BeBetta or the BeBetta App (“BeBetta platform”) for participating in the Games (as defined below) and Bets (as defined below), engaging inSocial Events (as defined below) and accessing the Store (as defined below) available on BeBetta platform (“BeBetta Services”) shall be bound by these Terms of Use, and all other rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services.
BeBetta shall be entitled to modify these Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services, at any time, by posting the same on BeBetta. Use of BeBetta constitutes the User’s acceptance of such Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta in relation to any BeBetta Services, as may be amended from time to time. BeBetta may, at its sole discretion, also notify the User of any change or modification in these Terms of Use, rules and regulations and Terms of Use referred to herein or provided by BeBetta, by way of sending an email to the User’s registered email address or posting notifications in the User accounts. The User may then exercise the options provided in such an email or notification to indicate non-acceptance of the modified Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta. If such options are not exercised by the User within the time frame prescribed in the email or notification, the User will be deemed to have accepted the modified Terms of Use, rules, regulations and terms of use referred to herein or provided by BeBetta.
Certain BeBetta Services being provided on BeBetta may be subject to additional rules and regulations set down in that respect.
BeBetta may, at its sole and absolute discretion:
i. Restrict, suspend, or terminate any User’s access to all or any part of BeBetta or BeBetta Platform Services;
ii. Change, suspend, or discontinue all or any part of the BeBetta Platform Services;
iii. Reject, move, or remove any material that may be submitted by a User;
iv. Move or remove any content that is available on BeBetta Platform;
v. Establish general practices and limits concerning use of BeBetta Platform;
vi. Assign its rights and liabilities to all User accounts hereunder to any entity (post such assignment intimation of such assignment shall be sent to all Users to their registered email ids)
In the event any User breaches, or BeBetta reasonably believes that such User has breached these Terms of Use, or has illegally or improperly used BeBetta or the BeBetta Services, BeBetta may, at its sole and absolute discretion, and without any notice to the User, restrict, suspend or terminate such User’s access to all or any part of BeBettaServices or the BeBetta Platform, deactivate or delete the User’s account and all related information on the account, delete any content posted by the User on BeBetta and further, take technical and legal steps as it deems necessary.
Users consent to receiving communications such as announcements, administrative messages and advertisements from BeBetta or any of its partners, licensors or associates.
Intellectual Property
BeBetta includes a combination of content created by BeBetta, its partners, affiliates, licensors, associates and/or Users. The intellectual property rights (“Intellectual Property Rights”) in all software underlying BeBetta and the BeBetta Platform and material published on BeBetta, including (but not limited to) Games, Bets, Store Social Events, software, advertisements, written content, photographs, graphics, images, illustrations, marks, logos, audio or video clippings and flash animation, is owned by BeBetta, its partners, licensors and/or associates. Users may not modify, publish, transmit, participate in the transfer or sale of, reproduce, create derivative works of, distribute, publicly perform, publicly display, or in any way exploit any of the materials or content on BeBetta either in whole or in part without express written license from BeBetta
Users may request permission to use any BeBetta content by writing in to suppor@bebetta.in.
Users are solely responsible for all materials (whether publicly posted or privately transmitted) that they upload, post, e-mail, transmit, or otherwise make available on BeBetta (“Users’ Content”). Each User represents and warrants that he/she owns all Intellectual Property Rights in the User’s Content and that no part of the User’s Content infringes any third party rights. Users further confirm and undertake to not display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights of any third party on BeBetta. Users agree to indemnify and hold harmless BeBetta, its directors, employees, affiliates and assigns against all costs, damages, loss and harm including towards litigation costs and counsel fees, in respect of any third party claims that may be initiated including for infringement of Intellectual Property Rights arising out of such display or use of the names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on BeBetta, by such User or through the User's commissions or omissions
Users hereby grants to BeBetta and its affiliates, partners, licensors and associates a worldwide, irrevocable, royalty-free, non-exclusive, sub-licensable license to use, reproduce, create derivative works of, distribute, publicly perform, publicly display, transfer, transmit, and/or publish Users’ Content for any of the following purposes:
i. displaying Users’ Content on BeBetta
ii. distributing Users’ Content, either electronically or via other media, to other Users seeking to download or otherwise acquire it, and/or
iii. storing Users’ Content in a remote database accessible by end users, for a charge.
This license shall apply to the distribution and the storage of Users’ Content in any form, medium, or technology.
All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on BeBetta(s) belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners and any claims, controversy or issues against these names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights must be directly addressed to the respective parties under notice to BeBetta.
Third Party Sites, Services and Products
BeBetta may contain links to other internet sites owned and operated by third parties. Users’ use of each of those sites is subject to the conditions, if any, posted by the sites. BeBetta does not exercise control over any Internet sites apart from BeBettaand cannot be held responsible for any content residing in any third-party Internet site. BeBetta’s inclusion of third-party content or links to third-party Internet sites is not an endorsement by BeBetta of such third-party Internet site.
Users’ correspondence, transactions/offers or related activities with third parties, including payment providers and verification service providers, are solely between the User and that third party. Users’ correspondence, transactions and usage of the services/offers of such third party shall be subject to the terms and conditions, policies and other service terms adopted/implemented by such third party, and the User shall be solely responsible for reviewing the same prior to transacting or availing of the services/offers of such third party. User agrees that BeBetta will not be responsible or liable for any loss or damage of any sort incurred as a result of any such transactions/offers with third parties. Any questions, complaints, or claims related to any third party product or service should be directed to the appropriate vendor.
BeBetta contains content that is created by BeBetta as well as content provided by third parties. BeBetta does not guarantee the accuracy, integrity, quality of the content provided by third parties and such content may not relied upon by the Users in utilizing the BeBetta Services provided on BeBetta including while participating in any of the Bets hosted on BeBetta.

User Conduct
Users agree to abide by these Terms of Use and all other rules, regulations and terms of use of the Website. In the event User does not abide by these Terms of Use and all other rules, regulations and terms of use, BeBetta may, at its sole and absolute discretion, take necessary remedial action, including but not limited to:
i. restricting, suspending, or terminating any User’s access to all or any part of BeBetta Services;
ii. deactivating or deleting a User’s account and all related information and files on the account.
Users agree to provide true, accurate, current and complete information at the time of registration and at all other times (as required by BeBetta). Users further agree to update and keep updated their registration information
Users agree and acknowledge that the address related details provided, if any, by the user shall be treated as “Address on record” of the user for the purposes of Goods and Service Tax Act. In the event of the change in such details, the user shall promptly update his/her profile on the BeBetta platform or write to BeBetta atsupport@bebetta.in.
A User shall not register or operate more than one User account with BeBetta.
Users agree to ensure that they can receive all communication from BeBetta by marking e-mails or sending SMSs from BeBetta as part of their “safe senders” list. BeBetta shall not be held liable if any e-mail/SMS remains unread by a User as a result of such e-mail getting delivered to the User’s junk or spam folder.
Users are responsible for maintaining the confidentiality of their accounts and passwords. Users agree to immediately notify BeBetta of any unauthorized use of accounts or any other breach of security.
Users agree to exit/log-out of their accounts at the end of each session. BeBetta shall not be responsible for any loss or damage that may result if the User fails to comply with these requirements.
Users agree not to use cheats, exploits, automation, software, bots, hacks or any unauthorised third party software designed to modify or interfere with BeBetta Services and/or BeBetta experience or assist in such activity.
Users agree not to copy, modify, rent, lease, loan, sell, assign, distribute, reverse engineer, grant a security interest in, or otherwise transfer any right to the technology or software underlying BeBetta or BeBetta’s Services.
Users agree that without BeBetta’s express written consent, they shall not modify or cause to be modified any files or software that are part of BeBetta’s Services.
Users agree not to disrupt, overburden, or aid or assist in the disruption or overburdening of (a) any computer or server used to offer or support BeBetta or the BeBetta’s Services (each a “Server”); or (b) the enjoyment of BeBetta Services by any other User or person.
Users agree not to institute, assist or become involved in any type of attack, including without limitation to distribution of a virus, denial of service, or other attempts to disrupt BeBetta Services or any other person’s use or enjoyment of BeBetta Services.
Users shall not attempt to gain unauthorised access to the User accounts, Servers or networks connected to BeBetta Services by any means other than the User interface provided by BeBetta, including but not limited to, by circumventing or modifying, attempting to circumvent or modify, or encouraging or assisting any other person to circumvent or modify, any security, technology, device, or software that underlies or is part of BeBetta Services.
User shall not to publish any content that is patently false and untrue, and is written or published in any form, with the intent to mislead or harass a person, entity or agency for financial gain or to cause any injury to any person.
Without limiting the foregoing, Users agree not to use BeBetta for any of the following:
i. To engage in any obscene, offensive, indecent, racial, communal, anti-national, objectionable, defamatory or abusive action or communication;
ii. To harass, stalk, threaten, or otherwise violate any legal rights of other individuals;
iii. To publish, post, upload, e-mail, distribute, or disseminate (collectively, “Transmit”) any inappropriate, profane, defamatory, infringing, obscene, indecent, or unlawful content;
iv. To Transmit files that contain viruses, corrupted files, or any other similar software or programs that may damage or adversely affect the operation of another person's computer, BeBetta, any software, hardware, or telecommunications equipment;
v. To advertise, offer or sell any goods or services for any commercial purpose on BeBetta without the express written consent of BeBetta;
vi. To download any file, recompile or disassemble or otherwise affect our products that you know or reasonably should know cannot be legally obtained in such manner;
vii. To falsify or delete any author attributions, legal or other proper notices or proprietary designations or labels of the origin or the source of software or other material;
viii. To restrict or inhibit any other user from using and enjoying any public area within our sites;
ix. To collect or store personal information about other Users;
x. To interfere with or disrupt BeBetta, servers, or networks;
xi. To impersonate any person or entity, including, but not limited to, a representative of BeBetta, or falsely state or otherwise misrepresent User's affiliation with a person or entity;
xii. To forge headers or manipulate identifiers or other data in order to disguise the origin of any content transmitted through BeBetta or to manipulate User’s presence on BeBetta(s);
xiii. To take any action that imposes an unreasonably or disproportionately large load on our infrastructure;
xiv. To engage in any illegal activities. You agree to use our bulletin board services, chat areas, news groups, forums, communities and/or message or communication facilities (collectively, the “Forums”) only to send and receive messages and material that are proper and related to that particular Forum.
xv. To engage in any action that threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign States, or public order, or causes incitement to the commission of any cognisable offence or prevents investigation of any offence or is insulting other nation.
If a User chooses a username that, in BeBetta’s considered opinion is obscene, indecent, abusive or that might subject BeBetta to public disparagement or scorn, as the case may be, BeBetta reserves the right, without prior notice to the User, to restrict usage of such names, which in BeBetta’s opinion fall within any of the said categories and/or change such username and intimate the User or delete such username and posts from BeBetta, deny such User access to BeBetta, or any combination of these options.
Unauthorized access to BeBetta is a breach of these Terms of Use, and a violation of the law. Users agree not to access BeBetta by any means other than through the interface that is provided by BeBetta for use in accessing BeBetta. Users agree not to use any automated means, including, without limitation, agents, robots, scripts, or spiders, to access, monitor, or copy any part of our sites, except those automated means that we have approved in advance and in writing.
Use of BeBetta is subject to existing laws and legal processes. Nothing contained in these Terms of Use shall limit BeBetta’s right to comply with governmental, court, and law-enforcement requests or requirements relating to Users' use of BeBetta.

support@bebetta.inif the user has any concerns with regard to a match and/or Bets within Forty Eight (48) hours of winner declaration for the concerned Bet.
Persons below the age of eighteen (18) years are not allowed to participate on any of the Bets, games (by whatever name called) on the BeBetta Platform. The Users will have to disclose their real age at the time of getting access into the BeBetta Platform.
BeBetta may not be held responsible for any content contributed by Users on the BeBetta.
User hereby confirms that he / she is participating in a Bet in personal capacity and not in the course of business and /or profession.
Bets, Games, Store and Social
(a) Bets
Users are provided with the option to engage in various types of bets within the BeBetta mobile application (“Bets”). The types of Bets available may be modified by BeBetta at its discretion and without prior notice. Users have the flexibility to select their preferred Sport from those available on the Platform and then choose to participate in the available Bets. Additionally, in certain scenarios, users may be granted the privilege to create their own Bets.
(For the purpose of this Terms of Use, “Sports” encompasses a range of athletic competitions and games available for Users to engage with. Users can select their desired sport from those offered on the platform, which may include popular sports such as cricket, football, kabaddi, basketball, hockey, and others)
Participation in Bets is facilitated through the use of “Betcoins”, which serve as virtual currency within the platform. These Betcoins are utilized exclusively for engaging in bets and hold no intrinsic monetary value outside of the BeBetta application.
Users have the right to participate in the various types of Bets offered within the BeBetta App. This includes the freedom to select their desired Sport, choose from available Bet options, and engage in predictive activities using Betcoins.
In certain scenarios, Users may be privileged with the opportunity to create their own Bets, thereby exercising their creativity and ingenuity in devising unique betting scenarios. This empowers users to actively contribute to the dynamic nature of the platform and fosters a sense of ownership and engagement within the BeBetta community.
Users are obligated to comply with the Terms of Use and all applicable rules and regulations governing the participation in Bets within the BeBetta App. This includes adherence to the specified Bet types, Sports events, and guidelines outlined by BeBetta.
Users are prohibited from engaging in any form of cheating, fraud, or misconduct that undermines the integrity of the Platform. This includes but is not limited to collusion, manipulation of outcomes, use of automated bots, or any other unauthorized means to gain an unfair advantage in betting activities.
BeBetta reserves the right to modify the types of Bets offered within the Platform, including the addition or removal of Bet options, Sports events, or any other features.
BeBetta retains the authority to enforce the Terms of Use and take appropriate action against Users found to be in violation of the stipulated guidelines in accordance with User Conduct policy stipulated herein above.
By participating in bets within the BeBetta application, users acknowledge and agree to abide by the Terms of Use and all applicable rules and regulations. BeBetta reserves the right to take appropriate action against any user found to be in violation of these terms, including but not limited to account suspension or termination.
PLEASE BE INFORMED THAT ALL ACTIVITIES WITHIN THE BEBETTA MOBILE APPLICATION, INCLUDING BUT NOT LIMITED TO BETS, ARE STRICTLY FOR ENTERTAINMENT PURPOSES AND DO NOT INVOLVE THE STAKING OF REAL MONEY OR VALUABLE SECURITIES. USERS ENGAGE IN BETS USING VIRTUAL BETCOINS PROVIDED WITHIN THE APPLICATION, WHICH HOLD NO INTRINSIC MONETARY VALUE AND ARE SOLELY FOR RECREATIONAL USE. IT IS IMPORTANT TO NOTE THAT THE ASSAM GAME AND BETTING ACT, 1970 DEFINES A ‘BET’ AS ANY MONEY OR VALUABLE SECURITY STAKED ON THE OUTCOME OF AN UNASCERTAINED EVENT OR CONTINGENCY IN RELATION TO A GAME OR SPORT. HOWEVER, BETS WITHIN THE BEBETTA APP DO NOT FALL UNDER THIS DEFINITION AS THEY ARE CONDUCTED EXCLUSIVELY WITH BETCOINS AND DO NOT INVOLVE REAL MONETARY TRANSACTIONS OR HOLD AS ANY VALUABLE SECURITY.
BY PARTICIPATING IN BETS WITHIN THE BEBETTA MOBILE APP, USERS ACKNOWLEDGE AND AGREE THAT THEY ARE ENGAGING IN ACTIVITIES THAT SIMULATE BETTING SCENARIOS FOR ENTERTAINMENT PURPOSES ONLY. USERS ARE NOT STAKING REAL MONEY OR VALUABLE SECURITIES ON THE OUTCOME OF ANY EVENT OR CONTINGENCY.BEBETTA OPERATES IN COMPLIANCE WITH ALL APPLICABLE LAWS AND REGULATIONS, ENSURING THAT ALL ACTIVITIES WITHIN THE APPLICATION ADHERE TO LEGAL STANDARDS. THE PLATFORM STRICTLY PROHIBITS THE USE OF REAL MONEY FOR BETTING PURPOSES AND DOES NOT FACILITATE ANY FORM OF REAL MONEY GAMBLING.

Within the BeBetta App, “Games” refer to the interactive activities and challenges provided for User entertainment and engagement. These games may range from casual puzzles to competitive challenges and are designed to offer diverse gaming experiences to the Users.Users have the right to participate in the Games, earnRewards, and open Mystery Boxes offered within the BeBetta App. This includes the freedom to engage with various gaming activities and earn rewards based on their performance and achievements.
“Rewards”denote the incentives and benefits that Users can earn through Games, and other interactive activities within the BeBetta Platform. These rewards may include Betcoins, bonuses, or other incentives aimed at enhancing the User experience.
Users have the liberty to select and play Games of their choice from the diverse selection available within BeBetta App. They also have the option to avail themselves of Mystery Boxes to discover exciting rewards.
BeBetta retains full control over the Games, Rewards, and Mystery Boxes offered within the platform. This includes the right to modify, update, or remove Games, Rewards, or offers at its discretion to enhance User engagement and ensure a dynamic gaming environment.
BeBetta reserves the right to allocate Rewards to Users based on their performance, achievements, and participation within the Platform. The allocation of Rewards is determined by BeBetta and may vary based on various factors.
BeBetta may introduce offers, free bonuses, or special events from time to time to incentivize user engagement and participation. These offers are subject to change or discontinuation at the discretion of BeBetta, without prior notice to users.
Users are prohibited from engaging in any form of cheating, fraud, or misconduct that undermines the integrity of the Gaming activities. This includes but is not limited to exploiting loopholes, using unauthorized tools or software, or engaging in behaviour that provides an unfair advantage over other users.
Users are not permitted to abuse or exploit Rewards, bonuses, or Mystery Boxes for personal gain or advantage. This includes but is not limited to creating multiple accounts, manipulating Reward systems, or engaging in fraudulent activities to obtain rewards unfairly.
BeBetta reserves the right to modify, update, or amend the Terms of Use relating to games, rewards, and Mystery Boxes at any time without prior notice. Users are encouraged to review the Terms of Use periodically to stay informed about any changes or updates.
(c) Social Space
Users of the BeBetta App have the opportunity to engage in a vibrant social space, where they can connect with like-minded individuals, join communities, and interact with other Users who share similar interests and preferences.Users are welcome to join communities within the BeBetta Platform based on their favourite teams, sports, or any other criteria deemed appropriate by BeBetta. By joining a community, Users agree to abide by the community guidelines established by BeBetta from time to time and uphold the principles of respect, civility, and inclusivity.
Users are expected to engage in respectful and courteous conduct when interacting with other Users of the community. Any form of harassment, discrimination, hate speech, or abusive behaviour towards other Users will not be tolerated and may result in immediate suspension or termination of the User’s account.
Users are responsible for maintaining the privacy and confidentiality of their personal information and any sensitive data shared within the community. BeBetta shall not be held liable for any unauthorized disclosure of user information resulting from user actions or negligence.
Users are strictly prohibited from sharing or posting any content that is illegal, infringes upon the rights of others, or violates the community guidelines set forth by BeBetta. This includes but is not limited to copyrighted material, obscene or explicit content, malicious software, or any form of deceptive or fraudulent content.
BeBetta reserves the right to monitor community activities and interactions within the platform to ensure compliance with the Terms of Use and community guidelines. BeBetta may take appropriate action, including but not limited to warning, suspension, or termination of user accounts, in response to violations of the Terms of Use or community guidelines.
Users are encouraged to report any violations of the Terms of Use or community guidelines to BeBetta for prompt investigation and resolution. Reports can be submitted through the designated channels provided within the BeBetta application.
BeBetta reserves the right to modify, update, or amend the Terms of Use relating to the social space features of the platform at any time without prior notice. Users are encouraged to review the Terms of Use periodically to stay informed about any changes or updates.
(d) Store
The Store within the BeBetta App offers Users the opportunity to participate in a bidding system for various products listed on the platform. Users can view active or upcoming bids and choose to place bids on products of interest.In addition to products, Users may also have the option to purchase or bid on coupons facilitated by BeBetta within the Store. These coupons may provide discounts, special offers, or other benefits redeemable within the BeBetta App or with third-party partners.
Users understand that placing a bid constitutes a commitment to purchase the item or coupon at the bid price if their bid is successful.
BeBetta strives to provide accurate and detailed descriptions of products listed within the Store. However, Users acknowledge that product information, including but not limited to images, descriptions, and specifications, may be provided by third-party vendors or suppliers. BeBetta does not guarantee the accuracy or completeness of such information and shall not be held liable for any discrepancies or inaccuracies.
Users understand that the bidding process operates on a competitive basis, where the highest bidder at the end of the bidding period wins the item or coupon. Users are responsible for monitoring their bids and ensuring they meet the specified bid requirements, including bid increments and minimum bid amounts.
The availability of products within the Store is subject to change and may be limited based on stock availability or other factors. BeBetta does not guarantee the availability of any specific product and reserves the right to remove or modify product listings at any time without prior notice.
Users acknowledge that certain products listed within the Store may be sourced from third-party vendors or suppliers. BeBetta acts solely as a facilitator for the bidding process and does not assume responsibility for the quality, authenticity, or performance of third-party products. Users agree to direct any inquiries or concerns regarding third-party products to the respective vendors or suppliers.
Coupons purchased or won through the bidding system may be subject to specific terms and conditions outlined by BeBetta or the issuing party. Users are responsible for reviewing and complying with any redemption requirements associated with coupons, including validity periods, usage restrictions, and eligibility criteria.
(e) Lotto
Section 1: General Terms
1) Acceptance of Terms: By accessing or using the BeBetta platform, you agree to be bound by these Terms and Conditions.
2) Promoter: Isocial Sports Private Limited (ISSPL) is the operator and promoter of all competitions on the BeBetta platform.
3) Eligibility: Competitions are open to Indian residents aged 18 or over. Employees of ISSPL and their immediate family members are ineligible to participate.
Section 2: Participation
1) Registration: To participate, you must create a registered account on the BeBetta platform.
2) Purchase of Passes: You can enter competitions by purchasing Passes. Each Pass represents one entry.
3) Payment: Payments will be processed through authorized payment gateways. ISSPL is not responsible for any issues related to payment processing.
Section 3: Competitions
1) Lotto Draws: The BeBetta platform will conduct Lotto draws at specified times.
2) Winning Criteria: Winners will be determined through a random draw.
3) Prize Distribution: Prizes will be awarded to the winners as per the terms and conditions of each competition.
4) Prize Claim: Winners may be required to provide identification and address verification to claim their prizes.
Section 4: Rules of Conduct
1) Fair Play: Participants must adhere to fair play principles and avoid any fraudulent or manipulative activities.

3) Account Termination: ISSPL reserves the right to terminate accounts of participants who violate these Terms and Conditions.
Section 5: Limitation of Liability
1) No Warranty: ISSPL does not guarantee the accuracy, completeness, or reliability of any information provided on the platform.
2) Risk of Loss: You assume the risk of any loss or damage arising from your participation in competitions.
3) Indemnification: You agree to indemnify and hold ISSPL harmless from any claims or damages arising from your use of the platform.
Section 6: Governing Law
1) Indian Jurisdiction: These Terms and Conditions shall be governed by and construed in accordance with the laws of India.
2) Dispute Resolution: Any disputes arising from these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts in India
Legality of Game of Skill
Games of skill are legal, as they are excluded from the ambit of Indian gambling legislations including, the Public Gambling Act of 1867.The Indian Supreme Court in the cases of State of Andhra Pradesh v. K Satyanarayana (AIR 1968 SC 825) and KR Lakshmanan v. State of Tamil Nadu (AIR 1996 SC 1153) has held that a game in which success depends predominantly upon the superior knowledge, training, attention, experience and adroitness of the player shall be classified as a game of skill.
The Bet(s) described above (across the BeBetta Services) are games of skill as success of Participants depends primarily on their superior knowledge of the games/ sports/ statistics, knowledge of players’ relative form, players’ performance in a particular territory, conditions and/or format (such as ODIs, test cricket and Twenty20 in cricket game), attention and dedication towards the Bet(s) and adroitness in playing the Bet(s). The Bet(s) also requires Participants to field well-balanced sides with limited resources and make substitutions at appropriate times to gain the maximum points.
By participating in this Bet(s), each Participant acknowledges and agrees that he/she is participating in a game of skill.
Eligibility
The Bet(s) are open only to persons above the age of 18 years.
The Bet(s) are open only to persons, currently residing in India.
Only those Participants who have successfully registered on BeBetta as well as registered prior to each match in accordance with the procedure outlined above shall be eligible to participate in the Bet and win Betcoins.
Miscellaneous
The decision of BeBetta with respect to the awarding of Rewards shall be final, binding and non-contestable.
If it is found that a Participant playing the Bet(s) is under the age of eighteen (18), BeBetta shall be entitled, at its sole and absolute discretion, to disqualify such Participant and forfeit his/her prize. Further, BeBetta may, at its sole and absolute discretion, suspend or terminate such Participant's account.
To the extent permitted by law, BeBetta makes no representations or warranties as to the quality, suitability or merchantability of any Rewards or products and shall not be liable in respect of the same.
BeBetta may, at its sole and absolute discretion, vary or modify the Rewards being offered to winners. Users shall not raise any claim against BeBetta or question its right to modify such rewards being offered, prior to closure of the Bets.
BeBetta will not bear any responsibility for the transportation or packaging of Rewards to the respective winners. BeBetta shall not be held liable for any loss or damage caused to any Rewards at the time of such transportation.
The Winners shall bear the shipping, courier or any other delivery cost in respect of the Rewards.
The Winners shall bear all transaction charges levied for delivery of cash prizes.
All Rewards are non-transferable and non-refundable. Rewards cannot be exchanged / redeemed for cash or kind. No cash claims can be made in lieu of prizes in kind.
General Conditions
If it comes to the notice of BeBetta that any governmental, statutory or regulatory compliances or approvals are required for conducting any Bet(s) or Games or if it comes to the notice of BeBetta that conduct of any such Bet(s) or Games is prohibited, then BeBetta shall withdraw and / or cancel such Bet(s) without prior notice to any Users of any Bet(s). Users agree not to make any claim in respect of such cancellation or withdrawal of the Bet or contest it in any manner.
Dispute and Dispute Resolution
The courts of competent jurisdiction at Ahmedabad, Gujarat shall have exclusive jurisdiction to determine any and all disputes arising out of, or in connection with, the BeBetta Services provided by BeBetta (including the Bet(s)), the construction, validity, interpretation and enforceability of these Terms of Use, or the rights and obligations of the User(s) (including Participants) or BeBetta, as well as the exclusive jurisdiction to grant interim or preliminary relief in case of any dispute referred to arbitration as given below. All such issues and questions shall be governed and construed in accordance with the laws of the Republic of India.
In the event of any legal dispute (which may be a legal issue or question) which may arise, the party raising the dispute shall provide a written notification (“Notification”) to the other party. On receipt of Notification, the parties shall first try to resolve the dispute through discussions. In the event that the parties are unable to resolve the dispute within fifteen (15) days of receipt of Notification, the dispute shall be settled by arbitration.
The place of arbitration shall be Ahmedabad, Gujarat, India. All arbitration proceedings shall be conducted in English and in accordance with the provisions of the Arbitration and Conciliation Act, 1996, as amended from time to time.
The arbitration award will be final and binding on the Parties, and each Party will bear its own costs of arbitration and equally share the fees of the arbitrator unless the arbitral tribunal decides otherwise. The arbitrator shall be entitled to pass interim orders and awards, including the orders for specific performance and such orders would be enforceable in competent courts. The arbitrator shall give a reasoned award.
Nothing contained in these Terms of Use shall prevent BeBetta from seeking and obtaining interim or permanent equitable or injunctive relief, or any other relief available to safeguard BeBetta’s interest prior to, during or following the filing of arbitration proceedings or pending the execution of a decision or award in connection with any arbitration proceedings from any court having jurisdiction to grant the same. The pursuit of equitable or injunctive relief shall not constitute a waiver on the part of BeBetta to pursue any remedy for monetary damages through the arbitration described herein.
Release and Limitations of Liability
Users shall access the BeBetta Services provided on BeBetta voluntarily and at their own risk. BeBetta shall, under no circumstances be held responsible or liable on account of any loss or damage sustained (including but not limited to any accident, injury, death, loss of property) by Users or any other person or entity during the course of access to the BeBetta Services (including participation in the Bet(s)) or as a result of acceptance of any prize.
By entering the Bets and accessing the BeBetta Services provided therein, Users hereby release from and agree to indemnify BeBetta, and/ or any of its directors, employees, partners, associates and licensors, from and against all liability, cost, loss or expense arising out their access to the BeBetta Services including (but not limited to) personal injury and damage to property and whether direct, indirect, consequential, foreseeable, due to some negligent act or omission on their part, or otherwise.
BeBetta accepts no liability, whether jointly or severally, for any errors or omissions, whether on behalf of itself or third parties in relation to the prizes.
Users shall be solely responsible for any consequences which may arise due to their access of BeBetta Services by conducting an illegal act or due to non-conformity with these Terms of Use and other rules and regulations in relation to BeBetta Services, including provision of incorrect address or other personal details. Users also undertake to indemnify BeBetta and their respective officers, directors, employees and agents on the happening of such an event (including without limitation cost of attorney, legal charges etc.) on full indemnity basis for any loss/damage suffered by BeBetta on account of such act on the part of the Users.
Users shall indemnify, defend, and hold BeBetta harmless from any third party/entity/organization claims arising from or related to such User's engagement with the BeBetta or participation in any Bets. In no event shall BeBetta be liable to any User for acts or omissions arising out of or related to User’s engagement with the BeBetta or his/her participation in any Bet(s) or bidding of products on the Store.
In consideration of BeBetta allowing Users to access the BeBetta Services, to the maximum extent permitted by law, the Users waive and release each and every right or claim, all actions, causes of actions (present or future) each of them has or may have against BeBetta, its respective agents, directors, officers, business associates, group companies, sponsors, employees, or representatives for all and any injuries, accidents, or mishaps (whether known or unknown) or (whether anticipated or unanticipated) arising out of the provision of BeBetta Services or related to the Bets or the Rewards, or the purchase of products from the Store.
Grievance Redressal Mechanism
In case you have any complaints or grievance pertaining to (i) any User Content that you believe violates these Terms (other than an infringement of Intellectual Property Rights) for the reporting mechanism for such claims), (ii) your access to the Platform or (iii) any User Content which you believe is, prima facie, in the nature of any material which is obscene, defamatory towards the complainant or any person on whose behalf you are making the complaint, or is in the nature of impersonation in an electronic form, including artificially morphed images of such individual, please share the same with us by writing to:support@bebetta.in
In your complaint or grievance, please include the following information:
i. Your name and contact details: name, address, contact number and email address;
ii. Your relation to the subject matter of the complaint, i.e. complainant or person acting on behalf of an affected person;
iii. The name and age of the person aggrieved or affected by the subject matter of the complaint, in case your are acting on behalf of such person and a statement, under penalty of perjury, that you are authorised to act on behalf of such person and to provide such person's personal information to us in relation to the complaint/grievance;
iv. Description of the complaint or grievance with clear identification of the User Content in relation to which such complaint or grievance is made;
v. A statement that you believe, in good faith, that the User Content violates these Terms
vi. A statement that the information provided in the complaint or grievance is accurate.
The Company respects the Intellectual Property Rights of others. All names, logos, marks, labels, trademarks, copyrights or intellectual and proprietary rights on the Platform belonging to any person (including User), entity or third party are recognized as proprietary to the respective owners. You are requested to send us a written notice/ intimation if you notice any act of infringement on the Platform, which must include the following information:
i. A clear identification of the copyrighted work allegedly infringed;
ii. A clear identification of the allegedly infringing material on the Platform;
iii. Your contact details: name, address, e-mail address and phone number;
iv. A statement that you believe, in good faith, that the use of the copyrighted material allegedly infringed on the Platform is not authorized by your agent or the law;
v. A statement that the information provided in the notice is accurate, and under penalty of perjury, that the signatory is authorized to act on behalf of the owner of an exclusive copyright right that is allegedly infringed;
vi. Your signature or a signature of your authorized agent.

On receiving such complaint, grievance or notice, the Company reserves the right to investigate and/or take such action as the Company may deem appropriate. The Company may reach out to you to seek further clarification or assistance with the investigation, or verify the statements made in your complaint, grievance or notice, and you acknowledge that your timely assistance with the investigation would facilitate the redressal of the same.
